Terms & Conditions

Indemnity and Release 

Punching for a Cure Event (Event). 

In consideration of Perth Children’s Hospital Foundation’s (PCHF) acceptance of my application for registration in the Event, and in consideration of Radgloves Fitness Pty Ltd permitting me access to Rumble Subiaco at 1A/500 Hay Street WA, to participate in the Event, I agree to be bound by the terms of this document. 

I acknowledge that I have read and understand this document.

2. Participant Agreement

I acknowledge that the following terms apply to the Event on 5th and 6th March 2026 at Rumble Subiaco, and I agree to the following: 

1. Eligibility to Participate:

• Participants must be at least 18 years old on the Event date. 

• All donations are non-refundable and non-transferable. 

By registering for the Event, I confirm that: 

• I have assessed, and confirmed, my suitability and capability to fully and safely participate in the Event as contemplated in this Indemnity and Waiver. 

• I have read this document and understand the nature of the Event, including risks to me from participating in the Event 

• I will not expose myself to unacceptable safety, medical or other risks in connection with my participation in the event.  

• I consent and agree to participating in the Event on the Event Participation Conditions set out below, and on the other terms and conditions set out in this document. 

2. Compliance:

• I agree to adhere to all Event rules, instructions, and applicable laws. 

• PCHF reserves the right to modify or cancel the Event without notice. 

3. Assumption of Risk:

• Participation is voluntary and may involve potential risks, including physical injuries or other health issues, including mental health.  

• I am responsible for ensuring my own safety before, during and after the Event and understand that I can withdraw from participating in any capacity at any time without penalty or repercussions. 

• I confirm I am medically and physically fit to participate and assume full responsibility for my safety and well-being throughout the Event. 

4. Liability Release:

• To the extent permitted by law, I release all individuals and entities associated with the Event, including PCHF and Rumble Subiaco, from any claims, liabilities, or damages arising from participation, not limited to the items listed in this document. 

3. Event Participation Conditions

I consent and agree to participating in the Event and all activities at or in connection with the Event on the following basis: 

• The Event is voluntary, and I can withdraw from the Event at any time (in which case I will endeavour to give PCHF as much prior notice as reasonably possible in the circumstances). 

• I will follow any rules, guidelines or directions provided to me applying to the Event. 

• None of PCHF, Rumble Subiaco, or their related bodies corporate (as defined in the Corporations Act 2001), and none of the officers, employees, representatives, agents, contractors, and volunteers, of PCHF and Rumble Subiaco (Personnel), have assessed (and they will not assess, including after receiving the registration) whether it is suitable, appropriate or safe for me to participate in the Event (including due to any medical or other conditions or circumstances relating to me). 

• The Event involves risks (including high risks) which may lead to Personal Injury. 

• PCHF is a charity, and neither PCHF nor Rumble Subiaco would operate or be involved in the Event if they were at risk of being liable for such risks. 

• I will attend and participate in the Event at my own and sole risk. 

• If I am involved in an accident, become ill, or otherwise require medical treatment or care, PCHF may in its absolute discretion obtain medical treatment for me, in which case I must pay all expenses incurred in relation to that medical treatment or care being obtained. 

• I hereby absolutely and irrevocably release and forever discharge, and hold harmless, PCHF and Rumble Subiaco, and each of the Personnel, from all Liabilities which may arise, or be incurred, or sustained, by me whether now or in the future, in relation to, as a result of, or in connection with, my participation in the Event, including those relating to Personal Injury, however it occurs. 

• Non-identifying photographic or other images might be taken of me at the Event, and PCHF and Rumble Subiaco are authorised to make reasonable use of those images for promotional, fundraising and/or other purposes relating to their operations or the Event, but all personal information of, and provided by, me will be kept confidential and used only for purposes related to the Event. 

• This consent, including the acceptance of and agreement with these Event Participation Conditions, is given by me, in favour of PCHF, Rumble Subiaco, and each of the Personnel.  I agree that to the extent that an indemnity, release or any other obligation in this document is not given directly in favour of PCHF, Rumble Subiaco or any Personnel, PCHF holds indemnity, release or other obligation on trust for and their successors. 

4. Consent and Media Release

• I grant PCHF the right to use my name, photographs, and likeness in promotional materials, Event broadcasts, and marketing, in such manner as it sees fit (acting reasonably), without remuneration. 

5. Privacy Policy

• My personal information will be managed according to PCHF’s Privacy Policy which can be found here: https://pchf.org.au/policies/. 

6. Intellectual Property

• All content on the Event website is owned by PCHF and protected by copyright. Participants may not reproduce or distribute Event-related materials without prior consent. 

7. Refund Policy

• Registration fees and donations are non-refundable. 

8. General Provisions

1. This agreement is governed by the laws of Western Australia.
   
   
2. Any disputes will be subject to the exclusive jurisdiction of the courts in Western Australia.
   
   
3. If any provision is found invalid or unenforceable, the remaining terms shall remain in full effect.
   
   
4. In this document, Personal Injury includes death, serious or other physical, mental, or emotional, injury or strain (including the aggravation, exacerbation, acceleration, or recurrence, of such injury or strain, or any pre-existing, or past, such injury or strain), the contraction, aggravation, or acceleration, of a disease, or illness, the coming into existence, aggravation, exacerbation, acceleration, or recurrence, of any other condition, circumstance, occurrence, activity, form of behaviour, course of conduct, or state of affairs, that is, or may be, harmful, or disadvantageous, to the person who suffers it, or the community, or that may result in harm, or disadvantage, to the person who suffers it, or the community.
   
   
5. In this document, Liabilities means losses, damages, liabilities, costs, charges, expenses, outgoings, penalties, interest, and fines, including those arising as a result of any claim, allegation, action, proceeding, litigation, suit, or judgment, however arising, whether present, unascertained, immediate, future or contingent, whether or not based in tort, statute or otherwise. 

Declaration 

By registering, I: 

• Acknowledge and accept the terms of this document. 

• Confirm my understanding of the associated risks. 

• Agree to release PCHF, Rumble Subiaco and the Personnel, and all associated parties, from, and indemnify them in relation to, liability in connection with the Event to the fullest extent allowed by law.
